While estate agents may offer recommendations based on their experience with conveyancers, the choice of conveyancer ultimately lies with the seller. Sellers should feel empowered to select a conveyancer they trust, who will handle the legal aspects of the transaction with professionalism and efficiency.
Estate agents, while valuable in guiding the sales process, cannot dictate the choice of conveyancer. The seller’s decision should be based on service levels, reputation, and the conveyancer’s ability to meet their legal needs. Sellers are encouraged to ask estate agents for recommendations, but they should always make the final decision based on their comfort and confidence in the chosen conveyancer’s ability to handle the transaction with the necessary legal expertise.
THE VALUE OF CHOOSING THE RIGHT CONVEYANCER
Estate agents often recommend a conveyancer to their clients based on their track record, service levels, and ability to expedite transfers efficiently. A well-established, experienced conveyancer helps ensure that agents, sellers, and buyers experience a seamless process.
Sellers and buyers should, however, always feel confident in asking what is motivating the recommendation. A strong referral is one based on expertise and service – not incentives or sponsorships which are unlawful in terms of the Estate Agents Code of Conduct which requires that any referrals be based solely on service levels and the conveyancer’s ability to effectively handle the legal aspects of the transaction.
