From an estate duty point of view it is important to plan your estate. A resident is liable for estate duty at the rate of 20% on the net value of his or her assets as at date of death. A resident's estate includes his or her worldwide assets and deemed assets, the latter being life insurance policies, any pension lump sum payments and other funds payable on the death of the insured.


At present the dutiable amount of a deceased's estate must exceed R3.5 million to attract estate duty, and bequests to a surviving spouse are duty free.
